On Tuesday, June 1, 2021, the Supreme Court of the United States affirmed American Indian tribes’ sovereignty through a unanimous judgment, 9-0, in the case United States v. Cooley. The ruling affirms the authority of tribal law enforcement to detain temporarily and to search a non-Native American traveling on a public right-of-way running through a reservation for potential violations of state or federal law. An opinion was issued by Justices Breyer and Alito.
